AGREEMENT BETWEEN USER AND CHILDREN’S HEALTH COUNCIL
Children’s Health Council websites are comprised of various web pages operated by Children’s Health Council.
The Children’s Health Council websites are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Children’s Health Council websites constitutes your agreement to all such terms, conditions, and notices.
MODIFICATION OF THESE TERMS OF USE
Children’s Health Council reserves the right to change the terms, conditions, and notices under which the Children’s Health Council websites are offered, including but not limited to the charges associated with the use of the Children’s Health Council websites.
LINKS TO THIRD PARTY SITES
The Children’s Health Council websites may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Children’s Health Council, and Children’s Health Council is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site or any changes or updates to a Linked Site. Children’s Health Council is not responsible for webcasting or any other form of transmission received from any Linked Site. Children’s Health Council is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Children’s Health Council of the site or any association with its operators.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Children’s Health Council websites, you warrant to Children’s Health Council that you will not use the Children’s Health Council websites for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Children’s Health Council websites in any manner which could damage, disable, overburden, or impair the Children’s Health Council websites or interfere with any other party’s use and enjoyment of the Children’s Health Council websites. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Children’s Health Council websites.

The Children’s Health Council websites may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”). You agree to use the Communication Services only to post, send, and receive messages and materials that are proper and related to the particular Communication Service.
You agree that you will not:
Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others.
Post or distribute inappropriate, obscene, unlawful, or infringing material.
Upload files containing software or materials protected by intellectual property laws unless you own or control the rights.
Upload files that contain viruses, corrupted files, or similar harmful software.
Advertise or offer to sell or buy goods or services unless permitted by the Communication Service.
Conduct or forward surveys, contests, pyramid schemes, or chain letters.
Download files posted by another user that you know cannot legally be distributed.
Falsify or delete author attributions, legal notices, or proprietary labels.
Restrict or inhibit any other user from use of the Communication Services.
Violate applicable laws or regulations.
Harvest information about others without their consent.
Children’s Health Council reserves the right to review and remove materials at its discretion and may terminate your access at any time.
Children’s Health Council may disclose information as required by law or to protect its rights. Always use caution when giving personal information in any Communication Service. Children’s Health Council does not control or endorse the content found within such services.
Materials uploaded may be subject to limitations on use; you are responsible for observing these.
MATERIALS PROVIDED TO CHILDREN’S HEALTH COUNCIL OR POSTED AT ANY CHILDREN’S HEALTH COUNCIL WEBSITE
Children’s Health Council does not claim ownership of materials you submit. However, by submitting your content (“Submissions”), you grant Children’s Health Council and its affiliates permission to use your Submission in connection with their operations, including copying, distributing, transmitting, publicly displaying, editing, translating, and reformatting your Submission, and publishing your name in connection with it.
You receive no compensation for this usage. Children’s Health Council is not obligated to post or use any Submission.
You warrant that you own or control all rights necessary to submit your materials.
LIABILITY DISCLAIMER
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE CHILDREN’S HEALTH COUNCIL WEBSITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY MADE TO THE INFORMATION. CHILDREN’S HEALTH COUNCIL AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS OR CHANGES AT ANY TIME.
ADVICE RECEIVED VIA THE CHILDREN’S HEALTH COUNCIL WEBSITES SHOULD NOT BE RELIED UPON FOR PERSONAL, MEDICAL, LEGAL, OR FINANCIAL DECISIONS.
CHILDREN’S HEALTH COUNCIL AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF INFORMATION PROVIDED ON THE CHILDREN’S HEALTH COUNCIL WEBSITE. ALL MATERIALS AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHILDREN’S HEALTH COUNCIL AND/OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE CHILDREN’S HEALTH COUNCIL WEBSITES.
If you are dissatisfied with any portion of the Children’s Health Council websites or any terms of use, your sole remedy is to discontinue use.

GENERAL
This agreement is governed by the laws of the State of California. You consent to the exclusive jurisdiction of courts in San Francisco County, California.
Use of the Children’s Health Council websites is unauthorized in jurisdictions that do not give effect to these terms.
This agreement constitutes the entire agreement between the user and Children’s Health Council.
A printed version of this agreement shall be admissible in legal proceedings.

Trademarks appearing herein belong to their respective owners.
NOTICE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT
Claims under U.S. copyright law should be sent to the Service Provider’s Designated Agent. Only copyright complaints will receive a response.
